1. Acceptance of Terms
By accessing or using Megaphone ("the Platform"), operated by Megaphone Team ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of Service
Megaphone provides a platform that enables creators and businesses to create branded online stores, sell merchandise, and manage their e-commerce operations. We facilitate connections between store owners and third-party fulfillment providers.
3. Account Registration
To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for all activity under your account.
4. Store Owners
As a store owner on Megaphone, you are responsible for all products listed, pricing, descriptions, and the accuracy of your store content. You must comply with all applicable laws regarding the sale of your products and services. You are responsible for fulfilling orders and handling customer inquiries related to your products.
5. Payments and Fees
Payments are processed through Stripe. By using the Platform, you agree to Stripe's terms of service. Megaphone may charge a platform fee on transactions, which will be disclosed to you before you agree to use the service. All fees are non-refundable unless otherwise stated.
6. Intellectual Property
You retain ownership of all content you upload to the Platform. By uploading content, you grant Megaphone a non-exclusive, worldwide license to use, display, and distribute your content solely for the purpose of operating and promoting the Platform and your store.
7. Prohibited Conduct
You agree not to: (a) use the Platform for any unlawful purpose; (b) upload content that infringes on intellectual property rights; (c) attempt to interfere with the Platform's operation; (d) impersonate any person or entity; (e) sell counterfeit, illegal, or prohibited goods.
8. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may close your account at any time by contacting us.
9. Limitation of Liability
To the fullest extent permitted by law, Megaphone shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
